Terms and Conditions of Use

1) Acceptance of terms
By accessing and using the services of Explora Quisqueya ("Explora", "we", "our services"), including our website exploraquisqueya.com, our WhatsApp assistant and any related services, you ("user", "you") agree to be bound by these Terms and Conditions.
If you do not agree with any of these terms, you should not use our services.
2) Service description
Explora Quisqueya is a digital platform that uses artificial intelligence to:
- Provide personalized tourism recommendations in the Dominican Republic
- Connect users with local tourism experiences and services
- Facilitate communication between users and tourism service providers
- Offer conversational assistance through WhatsApp
Our services are provided "as is" and may include functionalities under development during the beta phase.
3) Eligibility and registration
3.1 Minimum age
You must be at least 18 years old to use our services. If you are under 18, you must have the consent of your parents or legal guardian.
3.2 Accurate information
You agree to provide truthful, accurate and updated information during the use of our services.
3.3 User responsibility
You are responsible for maintaining the confidentiality of your contact information and all activities that occur under your account.
4) Acceptable use
By using our services, you agree to:
- Use the services only for legal and legitimate purposes
- Not interfere with the normal operation of the platform
- Not attempt to gain unauthorized access to our systems
- Not use the service for spam, fraud or malicious activities
- Respect intellectual property rights
- Not post offensive, defamatory or inappropriate content
5) Third-party services
5.1 Tourism providers
Explora Quisqueya acts as an intermediary between users and independent tourism service providers (agencies, guides, operators). We are not responsible for the quality, availability or fulfillment of services offered by third parties.
5.2 Contractual relationship
When you make a reservation or contract a service through our platform, your primary contractual relationship will be with the service provider, not with Explora Quisqueya.
5.3 Dispute resolution
Any dispute related to third-party services must be resolved directly with the corresponding provider.
6) Payments and transactions
6.1 Payment processing
Payments are processed through CardNet, our authorized payment service provider. We do not store complete credit card information in our systems.
6.2 Prices and availability
Displayed prices are subject to change without prior notice. Service availability is not guaranteed until final confirmation from the provider.
6.3 Refunds and cancellations
Refund and cancellation policies are determined by each individual service provider. Explora Quisqueya will facilitate communication but does not guarantee refunds.
7) Intellectual property
All platform content, including text, graphics, logos, icons, images, audio clips, digital downloads and software, is owned by Explora Quisqueya or its licensors and is protected by copyright laws.
You are granted a limited, non-exclusive and non-transferable license to use our services solely for personal and non-commercial purposes.
8) Privacy and personal data
The processing of your personal data is governed by our Privacy Policy, which forms an integral part of these terms.
By using our services, you consent to the processing of your personal data as described in said policy.
9) Limitation of liability
9.1 Disclaimer of warranties
Our services are provided "as is" and "as available". We offer no express or implied warranties regarding the accuracy, reliability or continuous availability of the service.
9.2 Limitation of damages
In no event shall Explora Quisqueya be liable for indirect, incidental, special, consequential or punitive damages, including loss of profits, data or use.
9.3 Maximum liability
Our total liability to you for any claim shall not exceed the amount paid by you to Explora Quisqueya in the 12 months prior to the event giving rise to the claim.
10) Indemnification
You agree to indemnify and hold harmless Explora Quisqueya, its affiliates, directors, employees and agents from any claim, loss, liability, damage or expense (including attorney fees) arising from:
- Your use of our services
- Your violation of these terms
- Your violation of third party rights
- Any content you provide
11) Service and terms modifications
11.1 Service changes
We reserve the right to modify, suspend or discontinue any aspect of our services at any time, with or without prior notice.
11.2 Terms modifications
We may update these terms occasionally. Substantial changes will be notified at least 30 days in advance. Continued use of our services after the changes take effect constitutes your acceptance of the new terms.
12) Termination
12.1 Termination by user
You may stop using our services at any time. To delete your data, follow the instructions in our Privacy Policy.
12.2 Termination by Explora Quisqueya
We may suspend or terminate your access to our services immediately, without prior notice, if you violate these terms or for any other reason at our sole discretion.
13) Applicable law and jurisdiction
These terms are governed by the laws of the Dominican Republic. Any dispute will be resolved in the competent courts of Santo Domingo, Dominican Republic.
14) General provisions
14.1 Severability
If any provision of these terms is declared invalid or unenforceable, the remaining provisions shall remain in full force and effect.
14.2 Complete agreement
These terms, together with our Privacy Policy, constitute the complete agreement between you and Explora Quisqueya.
14.3 Waiver
Failure to enforce any right or provision does not constitute a waiver of such right or provision.

16) Beta phase
Our services are currently in beta phase. This means that:

- Features may change without prior notice during this phase
